GENERAL CONDITIONS OF PURCHASE
1. GENERAL CONDITIONS OF PURCHASE AND SALE
This document establishes the general conditions of the contractual relationship that has as its object the purchase and sale of products by natural and/or legal persons who express their willingness to acquire the products and services made available to them by RMB SPORTS, SL with NIF: B13678008, responsible: Ramon Manzanera and address Calle Corró 290 2-C, 08401 Granollers (Barcelona), (hereinafter RMB SPORTS, SL), through the request made by electronic means, specifically, via the Internet through the website https://tframesport.comThe commercial relationship between T-Frame and the client will be governed by the general conditions set out here, at the time the order is placed.
2. PRE-PURCHASE INFORMATION AND USER ACCEPTANCE
These General Terms and Conditions of Sale are permanently displayed on the website owned by T-Frame, and all users may be previously informed of the price conditions, characteristics, rights and, in general, of all the conditions under which the sale will be carried out. These General Terms and Conditions, together with the specific request made via the Internet by the USER, imply the formalisation of the contract of sale between T-Frame and the USER, who declares that he/she is of legal age, has sufficient capacity to enter into a contract and has read, understood and accepted these terms and conditions.
3. DOCUMENTATION AND INFORMATION AFTER THE BUYS
T-Frame, at the time of purchase, unless there are reasons that justify a delay, will send to the email address previously specified by the USER, confirmation of the contracted product, cost, with a breakdown of taxes if applicable, as well as shipping costs, if assumed by the USER.
4. RIGHTS, OBLIGATIONS AND RESPONSIBILITIES OF T-FRAME.
4.1. DELIVERY OF THE PRODUCT.
T-Frame undertakes to deliver the product in perfect condition to the address indicated by the USER on the order form. T-Frame shall not be liable for errors in delivery when the data entered by the USER on the order form is incorrect or has been omitted. The delivery period begins when T-Frame receives the amount of the order by POS to the virtual account in its ownership.
T-Frame, in any case, undertakes to ensure that the shipment is made in the shortest possible time, with the normal duration being 48-72 working hours from Monday to Friday, from confirmation of payment in the Iberian Peninsula, 4-6 working days in the Balearic Islands. Delays in shipment do not imply the termination of the sale or give rise to compensation for this cause.
An online invoice detailing the entire order is included with each shipment. If you wish to request a tax-deductible invoice, the USER must contact the T-Frame administration by email contact@sportsrmb.com, who will request the billing information and will send the requested invoice as soon as possible. The recipient is obliged to check that the components ordered in their order from T-Frame and those on the invoice match. Likewise, the number of packages appearing on the carrier's delivery document must be checked to ensure that the number of packages delivered matches the number of packages delivered.
It is essential that any incident regarding the goods received or their packaging be noted in the observations section of the carrier's delivery document. It is also essential that any incident be reported to T-Frame within a maximum period of 24 hours by email to the address contact@sportsrmb.com .
In the event of cancellation/return of the order, the customer must pay the costs arising from the order, both delivery and return. All orders will be sent via a transport agency. If after two attempts it is impossible to deliver your order, the carrier will leave a receipt stating that the package will be in the branch nearest to your location for a period of 10 days. After the 10-day period has elapsed, the shipment will return to T-Frame.
4.2. T-FRAME'S LIABILITY
T-Frame shall in no event be liable:
- Errors and/or delays in access by the USER when entering their data in the order form, slowness or impossibility of receipt by the recipients of the order confirmation or any anomaly that may arise when these incidents are due to problems in the Internet network, causes of chance or force majeure and any other unforeseeable contingency beyond the good faith of the company.
- From errors or damages caused by inefficient and bad faith use of the service by the USER.
- From the non-operational nature of the email address provided by the USER for sending the order confirmation.
- From presentation errors, for example, errors in description, color or other errors of any other kind. Any customer may request additional information about any of the products at contact@sportsrmb.com.
- Product warranties are those established by the manufacturers. The warranty does not cover defects or breakages caused to the product by misuse, knocks, manipulation or other actions that lead to unjustified damage to the item. T-Frame accepts the return of products provided they are defective or do not reach the USER in correct condition. For more information on this point, read the section “Guarantees, Returns and Withdrawal” in these General Conditions.
- T-Frame reserves the right to make changes and updates to the information contained on the Website, its configuration and presentation and the conditions of access at any time and without prior notice. T-Frame reserves the right to interrupt access to its Website or any of its contents at any time and without prior notice.
The USER expressly waives any claim for contractual or pre-contractual liability for any possible damages or losses arising from the above in this clause. In any case, T-Frame's liability, if it fails to comply with the provisions of this agreement according to the terms of these general conditions, will be limited to the return of the amount of the products that, where applicable, the USER could have paid and always after the USER returns the product in question.
5. RIGHTS, OBLIGATIONS AND RESPONSIBILITIES OF THE USER.
5.1. PAYMENT
The USER agrees to pay in advance the amount for the product actually requested in the following amount and form:
(1). Amount of payment. – The remuneration for the product requested by the USER will be that indicated on the Website and that which appears in the specific request of the USER at any given time. The prices of the products that appear on the Website always appear with VAT included.
In addition, the price shown on the Website for each of the products offered must be increased by the relevant shipping costs, which will be made known to the USER unless shipping is free, a condition which will also be fully known to the USER.
All our prices are indicated in Euros.
(2). Payment methods. – The USER must pay the amount corresponding to the contracted service through:
– Payment via credit/debit card or Bizum.
5.2. USER RESPONSIBILITY
The USER assumes all risks of deterioration, damage, harm and loss of the products from the moment in which they have been made available to him by the third party who, on behalf of T-Frame, makes the delivery of the requested products and the latter signs the conformity of delivery, this signature implies the acceptance by the client that he has received the product in correct condition.
The USER undertakes to verify the good condition of the product before the third party who, on behalf of T-Frame, carries out the delivery of the requested product, a verification that will be carried out prior to signing the proof of delivery made.
6. WARRANTIES, RETURNS AND WITHDRAWAL
We reserve the right to accept returns after contacting us via our email address. contact@sportsrmb.com.
The warranty applies provided that the product is used under normal operating conditions determined by the manufacturers. T-Frame is not obliged to compensate the user or third parties for the consequences of the use of the product, whether direct or indirect damage, accidents suffered by people, damage to property other than the product, loss of profit or loss of earnings, damage resulting from deterioration.
Products are not covered by warranty for the following reasons:
- If, once delivered to the customer, they have been damaged due to external factors, accidents, poor following of instructions or changes in electrical voltages.
- Products modified or repaired by the USER are also excluded.
T-Frame will only accept the return of merchandise if:
(1). The merchandise has not been modified.
(2). Within the period established for this purpose by law, the USER may exercise his right to cancel or withdraw. Pursuant to the provisions of the Retail Trade Regulation Act, as well as those regulated by community regulations (Directive 97/7/EC), T-Frame will grant a period of 7 days for this right, counted from the moment of receipt of the order. In this case, the customer may return any product without any type of incident. T-Frame will accept the exercise of the aforementioned right only and exclusively when the merchandise is in the same condition (not unsealed) in which it was delivered, with its corresponding original packaging and with all the products that made up the order. The product must be in perfect condition and ready for sale, in addition to having met the requirements established in the point that describes the delivery (Point "Delivery of the product"). The USER will assume the costs derived from the return and free shipping if there were
enjoyed it.
(3). Likewise, if T-Frame makes a shipment and the USER, for reasons beyond T-Frame's control, decides to reject the order, the USER will assume the costs derived from both the delivery shipment and the return of the package to T-Frame, plus commissions and management costs.
(4). T-Frame will accept the return of the merchandise when the product delivered does not correspond to that requested by the customer (that does not match the one specified in the order and for reasons attributable to T-Frame) provided that T-Frame has not previously communicated this to the customer and has obtained his express consent; or when the product has been damaged during transport, internally or externally, during its shipment. The merchandise travels to its destination fully insured by the transport company. Both to make the insurance effective and to correct any error in the delivery, it is an ESSENTIAL condition that any incident regarding the merchandise received or its packaging is recorded in the observations section of the carrier's delivery document and that said incident is communicated to T-Frame within a maximum period of 8 hours from the signature of receipt of the order. The USER, before signing the delivery of the order, must check that the product is delivered in perfect condition. If the USER gives his consent at the time of delivery, it is understood by both parties that the product was delivered in perfect condition. T-Frame shall not be liable for products that have already been consumed without any incident by the USER who intends to make a claim. T-Frame shall be exempt from all liability for any breakages or defects in the product packaging that occur after delivery if they have not been noted on the delivery note. If these conditions are not met, T-Frame shall not assume any liability for said merchandise. In this case, all collection and new delivery costs shall be borne by T-Frame.
The USER must notify T-Frame of the reason for the return by sending an email to contact@sportsrmb.com , indicating: (i) Name and Surname; (ii) Order number; (iii) Online invoice number; (iv) Contact telephone number; (v) Reason for which you wish to make the return; and, (vi) Any other
observation that you consider pertinent.
Once this information is received, your incident will be processed.
7. TERMINATION OF THE CONTRACT
T-Frame and the USER may terminate this contract for any of the reasons established by law and in particular for failure to comply with these General Conditions.
8. INDUSTRIAL AND INTELLECTUAL PROPERTY, COPYRIGHTS
The industrial and intellectual property of the logos, emblems, photographs, texts or other elements of this WEBSITE belong to their owners. Any violation of the intellectual or industrial property rights of this Website will be subject to appropriate legal measures to achieve their protection.
9. MODIFICATION OF THESE GENERAL PURCHASE CONDITIONS
The General Conditions of Purchase will be valid for the time they remain published on the Website, and will refer to the products purchased at the time when said conditions were available. T-Frame reserves the right to modify these General Conditions of Purchase to adapt them to new developments or legislative and jurisprudential requirements, as well as to industry practices, taking into account at all times the legitimate interests of the consumer or user. T-Frame reserves the right to modify them unilaterally, without affecting the products purchased by customers prior to the modification.
10. LEGAL NOTICE – JURISDICTION AND APPLICABLE LAW
These general conditions are governed by Spanish law, which will be applicable in relation to their validity, interpretation, execution and compliance. All discrepancies, claims and disputes regarding the above will be resolved by the Courts and Tribunals of the city of Granollers, the USER expressly waiving any other jurisdiction that may apply. In the event that any clause of this document is declared void, the other clauses will remain in force and will be interpreted taking into account the will of the parties and the purpose of these conditions. T-Frame may not exercise any of the rights and powers conferred in this document, which will not imply in any case the waiver of the same unless expressly acknowledged by T-Frame.
